Commercial customers must supply us with a Tax Exempt and Federal Tax ID number.
Pricing and Warranty:	All price quotations are made subject to market changes, exhausted supply or shortage beyond the control of MK Tree Farm. MK Tree Farm has a 1 year warranty.
Ordering:	All orders are confirmed with a 25% deposit to MK Tree Farm.
Cancellations:	Cancellations are subject to a 10% fee. Deposits will not be refunded if order is cancelled within ten days of delivery date. We reserve the right to reject all or any part of an order by refunding payments made.
Payment:	Balance is due upon pick up or delivery unless credit terms have been arranged.
Late Fees:	Any unpaid balance is subject to a monthly service charge of 1.5% per month with a minimum of $5.00. Any customer who fails to meet payment terms will be placed on C.O.D. terms until further notice.
F.O.B. Origin Terms:	All prices are F.O.B. our plantation unless otherwise stated.
Tree Care:	When caring for trees, please remember to keep stock out of the sun and wind until planting. Trees must be watered and planted or mulched as soon as possible after receipt. Removal of string reduces heat build-up in trees, which can lead to burning.
Special Requests:	Any special requests regarding orders are subject to a 25% surcharge. This includes tagging and special tree color requests. Any tree over 12’ in height may be tagged by the customer at no charge.
Limitation of Liability:	Buyer’s sole and exclusive remedies for any loss or damages shall be, at seller’s option, REFUND OF THE PURCHASE PRICE OF THE GOODS SOLD, OR REPLACEMENT IN KIND AND QUANTITY. In no event shall MK Tree Farm be liable for any other incidental or consequential damages (including loss of profits) of any kind, whether based on contract, tort or any other legal theory. By accepting the trees, the Buyer acknowledges that the disclaimers and limitations described herein are condition of sale and that they constitute the entire agreement between the parties regarding warranty and liability.
